Austin, TX (Law Firm Newswire) November 26, 2020 – A 17-year old budding baseball player from Waxahachie, Texas recently died from injuries sustained in a collision with an 18-wheeler.

The accident happened on U.S. Highway 287 near Waxahachie High School. Although the teen was taken to the nearest medical facility and put on life support, he succumbed to his injuries during transfer to another hospital.

The accident happened around 2:00 p.m. The teen’s vehicle was heading south on U.S. 287 when the driver apparently lost control, slid through the median and hit the big rig head-on. The driver was ejected. Passing drivers stopped to render aid until first responders arrived. It is not clear who was driving the teen’s vehicle at the time of the accident.

Collisions involving large trucks are too often fatal. This is due to their weight and size and the time it takes them to stop. If a victim does survive, they often find themselves dealing with life-altering injuries that can range from spinal cord injuries to amputations.

In this case, the teen’s family may decide to file a wrongful death lawsuit. Before that can happen, some questions need to be answered. Why the teen’s vehicle spun out of control? Was the driver texting? Was there a mechanical defect involving the vehicle? Was the driver under the influence of alcohol, street or prescription drugs? Who was driving at the time of the accident?

“Once some of these questions are answered, it provides the teen’s family with an idea of not only what happened and who may be liable, if they wish to file a wrongful death lawsuit,” explained Austin trucking accident and wrongful death attorney, Brooks Schuelke.

Generally, a wrongful death claim may apply is numerous situations where someone’s negligence or recklessness caused someone’s death. To prove a wrongful death occurred, the plaintiff needs to show that the person responsible had a duty of care and that they breached that duty and that in breaching that duty, the plaintiff was killed.

“Wrongful death cases are never easy for the family,” said Schuelke, who is not involved in the case, “but we are here to help those families navigate their way through a difficult process and obtain fair compensation for the loss of a loved one.” In the aftermath of a truck accident, make sure to speak with an experienced wrongful death, personal injury attorney as soon as possible to find out what your rights are.
