Florida Nursing Home Worker Arrested for Molesting and Abusing Elderly Patient

Tampa, FL (Law Firm Newswire) October 9, 2019 – A Florida woman who worked as a certified nursing aide in a Melbourne assisted living facility was charged with abuse of an elderly person and lewd and lascivious molestation of an elderly person.

The woman, 39, was arrested after being accused of sexually assaulting an elderly male patient she was caring for at the Brookshire assisted living facility. The patient had dementia and Alzheimer’s disease.

The nursing aide allegedly sexually assaulted the patient in the middle of the night on December 13, 2018. Her coworkers at the facility called the police after she was missing for almost two hours. The woman was eventually found naked and getting dressed in the patient’s bathroom.

“Nursing homes are required to provide residents with a reasonable standard of care,” said Tampa Bay Area personal injury lawyer Robert Joyce of Joyce and Reyes Law Firm P.A. “Sometimes the very people who are entrusted with the care of senior patients end up hurting them. Residents who have suffered abuse of any kind — whether sexual, physical or emotional — at the hands of nursing home staff are entitled to seek compensation for their injuries.”

According to police, the man seemed “distraught and confused” as he lay in his bed. He told officers that the nursing aide had sexually battered him. “She jumped on me and raped me,” the patient told police officers.

He was taken to a medical center where a sexual assault kit was conducted. The evidence from the kit and DNA testing confirmed his claims. However, investigators said the woman denied being in the room with the elderly patient during her overnight shift. She provided police with a swab of her saliva for DNA testing and allowed them to interview her via a translator.

The woman was immediately suspended and later fired from her job. She was being held at Brevard County Jail in lieu of $10,000. As a condition of her release, she would not be permitted to return to the assisted living facility or contact the patient.
