Florida Family to Sue Over Nursing Home Death

Tampa, FL (Law Firm Newswire) May 31, 2016 – A Florida family plans to sue a nursing home where an elderly woman died after a fall. The woman’s relatives say that the nursing home staff failed to give her proper medical attention and did not immediately notify the family of the accident.

According to the family, a nursing assistant was changing Nadine McBurnett’s bed sheets with the bed railing pulled down, when she fell off the bed. The family said that McBurnett had broken her hip in the fall, but nursing home workers simply placed her back on the bed without taking any action to get her medical treatment.

“Nursing home residents have certain rights, including the right to receive adequate and appropriate health care services and the right to be informed of the resident’s medical condition and of changes in care that may affect the resident’s well-being,” said Robert Joyce, a nursing home abuse and neglect attorney with the Tampa firm of Joyce & Reyes, who is not involved in the case. “When the violation of a resident’s rights causes injury, a lawsuit may be an appropriate way for the resident or their family to be compensated.”

McBurnett’s daughter, Patte Wallace, said that she did not learn that her mother had a broken hip until the family got her to the hospital. Wallace said that her mother had bruises on her head and shoulders when she got to the hospital. McBurnett lived for another month after the injury. According to the family’s attorney, there was a video camera outside the woman’s door, but the video recording was deleted.
