Boat Crashes Into Concrete Barge, Kills Two

Jan 29, 2016

Austin, TX (Law Firm Newswire) January 29, 2016 – Speed and alcohol may have been factors in the boating accident that killed two on Lake Austin in mid October.

The boat was being driven by well known Houston businessman, Shawn Hurwitz. Onboard were two men and two women. In the wee hours of the morning on a Sunday, lake residents placed at least two calls to the police complaining of loud music coming from the boat. It subsequently crashed into the side of a concrete barge at 5 a.m., killing Hurwitz, 50, and passenger Jennifer Walley, 34. Three others were seriously injured.

“At the time of the crash, the police report shows the boat was traveling at 40 miles per hour,” said Austin personal injury attorney, Bobby Lee, of Lee, Gober & Reyna, not involved in the case. What the police find baffling is how the boat crashed into a concrete barge that was relatively well lit. There was some speculation that due to the early hour, and pre-dawn darkness, Hurwitz, the pilot, did not see the barge that was in place to carry heavy equipment while workers built a dock.

By the time the police arrived at the scene of the crash, the boat Hurwitz had driven was sinking. Evidence showed that only one person onboard was wearing a lifejacket. It is not clear whether lifejackets would have saved the others given the force of the impact when the boat hit the side of the barge.

“While the police did not have a great deal to go on during their initial investigation, it is clear that the boat’s pilot was speeding just prior to the crash. If alcohol was a factor, it may also have contributed to the horrific collision,” said Lee.

The survivors of this collision might wish to discuss this case with a personal injury attorney and ask how they may seek compensation to pay for their injuries or seek recompense for a wrongful death. The accident is a deadly reminder to use due care and caution when boating. Follow the safety rules. Do not drink while boating and wear lifejackets.

“If you have been involved in a boating accident, you may contact my office for legal advice,” said Lee.

  • Hands-free driving in San Marcos is okay
Just recently, the city of San Marcos, Texas, passed an ordnance making it mandatory for drivers using a mobile device to use hands-free technology. While this new law has raised a few eyebrows from those who oppose any form of distracted driving, the law is only applicable when the car is moving. Any driver with a yen to text or talk may do so at a stop sign or red light. How that equates to safer driving is baffling, as numerous studies have clearly indicated that texting, surfing, webbing, going on Facebook, Twitter or Pinterest are all driver distractions that […]
  • Corpus Christi is not impressed with its new title: “The Drunkest City in Texas”
24/7 Wall Street just handed Corpus Christi, Texas, a new moniker that does nothing to enhance the city’s reputation. No city wants to be on public record for being the drunkest city in Texas. But the award of unwelcome designation should open people’s eyes to what is going on around them. The very real issue is that Corpus Christi has a higher rate of adults and juveniles in drug and alcohol treatment programs, and a higher death rate than the state as a whole. According to Dr. Phillip Rhoades, head of the Safe Communities Safe Driver Campaign, based at Texas […]
  • Trucker killed four under influence of synthetic marijuana
At first glance, the deadly crash on Sept. 26, 2014, that killed four baseball players from North Central College appeared to have been caused by distracted driving. The driver, with a documented history of drug use, crashed his semi into the bus carrying the team. The team bus was heading home to Gainsville, Texas, when the big rig maneuvered its way through a slight curve, […]
  • Talk Text Crash — Will the TxDOT Campaign Work?
The Texas Department of Transportation (TxDOT) wants to reduce the number of distracted driving collisions by stepping up its do not text and drive campaign. Dubbed “Talk, Text, Crash,” the newest campaign in a series of attempts to stop distracted driving is being promoted in all major Texas cities, including Austin and Houston. The thrust of this campaign is to encourage people to wait until they have reached their destination before using their smartphones to communicate with friends, family or the office. Texting or talking while driving is a distraction, and distracted driving kills. According to the TxDot, one in […]
