Florida Man Pleads Guilty to Federal Drug Charges in Pill Mill Case

Tampa, FL (Law Firm Newswire) November 25, 2015 – A Florida man pleaded guilty to federal drug charges for helping to operate pill mills.

Gerald Wiseberg of Boca Raton, Florida, pleaded guilty to conspiracy to distribute drugs including oxycodone. The plea agreement stated that Wiseberg owned and operated Total Care Medical Center, a pain management clinic in Deerfield Beach, Florida, in 2010 and 2011. Wiseberg was not a medical doctor, but he established the clinic’s operating procedures, according to the plea agreement. Wiseberg later opened another pain management clinic in Maryland.

“When unscrupulous doctors and other wrongdoers take advantage of vulnerable patients and people with substance abuse issues, they should face justice,” said Robert Joyce, a Tampa pharmaceutical negligence attorney with the law firm of Joyce & Reyes, who was not involved in the case. “The wrongdoers can face criminal charges as well as a civil suit for pharmaceutical negligence filed by the victims.”

According to Wiseberg’s plea agreement, he hired medical directors who he believed would write prescriptions for narcotics regardless of whether there was a medical need. The plea agreement also states that Wiseberg would travel back and forth from Maryland to Florida to direct the operations of the clinics, encouraging staff to give patients the prescriptions they requested. With regard to the Maryland clinic, about 97 percent of the customers of the clinic received at least one oxycodone prescription, and over 80 percent of the customers came from outside the state.

For each drug conspiracy charge, Wiseberg faces up to 20 years in prison. His sentencing is scheduled for March.
