Chorus Director, Camp Counselor Charged With Lewd Battery States Thomas Grajek, Lakeland Criminal Defense Lawyer

Sep 5, 2013

Lakeland, FL (Law Firm Newswire) September 4 , 2013 – The accused in this case allegedly masqueraded as a woman online to arrange for intimate relations with a 15-year-old boy.

“This case is not quite as unusual as it may sound,” commented Lakeland criminal defense lawyer, Thomas Grajek “More and more these days numerous individuals are using the Internet to make connections for legal and illegal activities. In this case, a 25-year-old man was charged with three counts of lascivious battery, also referred to as lewd battery, for luring a 15-year-old boy into having a sexual liaison.”

The man charged, Joseph Mendolia, allegedly represented himself online as a female, using the name Amanda. The University of South Florida music camp counsellor and chorus director for the Plant City Community Chorus also allegedly travelled to the boy’s location and had sexual relations with him.

After the man’s arrest, and during his interrogation, officers felt there may be other victims. Acting on that assumption, they put out a call to the general public asking for any other individuals who had contact with Mendolia to call them. The man was held on $60,000 bail in the local county lockup.

“In situations such as this reported case, the public’s perception of a crime of this nature is outrage and the alleged offender needs to retain experienced defense counsel,” Grajek pointed out. Many crimes like this have mandatory 25-year minimum prison sentences and sex crimes operate under different rules of evidence, which means they are more difficult to defend, not impossible, just more difficult.

“If you think you are the subject of a sexual allegation or have been charged with a sex crime, call me immediately. You have 5th Amendment rights and those constitutional rights must be fully protected. In the meantime, only speak to your legal counsel and no one else, or what you say will be used against you later,” added Grajek.

  • Lakeland DUI attorney Thomas C. Grajek quoted in Ledger article regarding DUI problems with LPD.
Today’s Ledger has another article regarding the problems with Lakeland Police department and their DUI unit that I discovered.  This deals with the problem with Lakeland’s DUI police reports.  The article dealt with LPD’s “internal investigation” regarding the policies and practices of its DUI unit and officers in general.  You can read the article here: http://www.theledger.com/article/20130816/NEWS/130819412/0/search As I previously explained in a  blog about Tampa ‘s Police Department conducting the same type of “investigation” these “investigations” have no teeth.  If you really want to fix your problems you need an independent critical eye looking at the police investigation.  That means […]
  • DNA Samples May Be Garnered from Criminal Suspects Without a Warrant
The legal landscape just changed with regard to obtaining a warrant to collect DNA from criminal offenders. The U.S. Supreme Court has delivered a decision that has enormous ramifications for criminal offenders and criminal defense attorneys. The Court handed down a ruling that says law enforcement officers may gather DNA samples without getting a warrant first and such a process does not violate the 4th Amendment (protection against unreasonable searches and seizures). While the Court indicates gathering DNA is a minor intrusion, there are others that suggest it will exponentially increase police powers – powers that may well be open […]
  • Polk County Sheriff deputy arrests man for DUI for riding a bicycle with only a 0.04 BREATH TEST LEVEL!!!
This week, a Mulberry man was arrested for Driving Under the Influence for allegedly riding his bike down the street while impaired.  Can a person get a DUI while riding a bike in Florida?  Yes! In Florida, a person is guilty of DUI if they are driving a “vehicle” while impaired.  Notice that “motor vehicle” is not used in this statute.  The definition of a “vehicle” determines whether or not a bicycle would qualify for a DUI, which is: “Vehicle’’ is every device, in, upon or by which any person or property is, or may be, transported or drawn upon […]
