22-Year-Old Trucker Loses Control Of Rig, Kills Four In Crash Relates Lee, Gober & Reyna

Sep 13, 2013

Austin, TX (Law Firm Newswire) September 12, 2013 – Inexperienced 18-wheeler truckers may be deadly on the road.

“It’s difficult enough to drive a big rig even if you have many years experience under you belt,” indicated Bobby Lee, an Austin injury lawyer of Lee, Gober & Reyna. “If you are just new to the world of long-haul trucking, inexperience handling trucks that weigh up to 80,000 pounds can be deadly, as it was in this case.”
It was late May and roughly 100 miles west of Fort Worth when four people lost their lives in an accident with an 18-wheeler. It happened when the 22-year-old trucker lost control of his rig on his way down a steep hill in Eastland County. Unable to regain control of the truck, he ended up driving over a concrete median, flipping over and crashing into two other vehicles, a 2008 Ford pickup and a 2011 Honda, travelling in the opposite direction.

The occupants in the Honda, all hailing from El Paso, were pronounced dead at the scene by emergency response personnel. The Ford driver, from Midland, was airlifted to the nearest hospital, where he succumbed to his injuries.

“Three people made it out of this monumental wreck, but will live with injuries varying from significant to catastrophic. A collision with a big rig never has a good outcome,” added Lee. “I’ve seen many such accidents in my years of practice and they are never easy to deal with for anyone, particularly the survivors.”
Those who did survive this crash may choose to sue the trucker and the company he works for. These cases are quagmires of jurisdictional issues, and usually mean multiple phalanxes of trucking company lawyers and insurance lawyers, all vying to reduce or diminish any possible accident claims.

“If you have been in an accident involving an 18-wheeler, call me. We need to immediately ensure the evidence at the crash site is secured and not tampered with and that includes obtaining access to the onboard black box. Additionally, do not speak to any insurance or trucking company representatives. Everything you say will be used against you later. You need to have your rights protected and obtain compensation for your injuries,“ added Lee.

  • Courts Attempt to Define the Term Accident
While it may be clear to some what the term accident means, it is still something that needs to be defined legally when it comes to insurance policies. In Johnson v. American United Life Insurance Co., the court was faced with determining whether the plaintiff’s husband, who had died in a car crash as a result of driving while under the influence, had met with an accident as defined in his life insurance policy, under his Accidental Death and Dismemberment coverage. The main issue in the case was that the man’s policy did not define the word “accident.” This resulted […]
  • Texting-while-driving restrictions need to apply to all ages across the board
It’s not just teenagers that text and drive. Adults do it too. In fact, most teens see their parents do it and rather than listen to what their parents say, they do what they see them doing instead. The results are deadly. The National Highway Traffic Safety Administration (NHTSA) statistics indicate that texting while driving is six times more dangerous than DWI/DUI. Texting involves taking your eyes off the road for an average of 4.6 seconds, and while that may not seem like a long time, it is long enough to cover the full length of a football field, as […]
  • Driving while “intexticated” is a serious issue for everyone
One young Texas man is lucky to still be alive today after spending six long months in hospital, due to texting while driving. Fortuitously, the man’s name is Chance; he got a second chance at life after a horrific accident where the engine of his truck landed in his lap after he plummeted into a ravine. He was pulled from the truck just before it burst into flames. Just prior to his crash, Chance was texting a friend. His last words were that it was dumb to be texting while driving and that if he kept doing it, he would […]
  • Motorcycle riders should not be put on trial if an accident was not their fault
Motorcycle riders are often regarded as second-class citizens on the road by other drivers, despite the fact that they have every right to be on the same road as cars and other vehicles. More often than not, any accident involved a biker and another vehicle was not the fault of the motorcycle driver. Usually, any accident was the result of a vehicle turning into the path of the biker. With nowhere else to go but into the side of the vehicle, accidents like this often seriously injure or kill the biker. And yet, if a case goes to trial, it […]
  • Alleged drunk driving causes a fatal accident
In a distressing case, two brothers went out for the night, and reportedly had several drinks. One of the brothers at some point got behind the wheel of his Pontiac Grand Am, with his brother in the passenger seat. The driver may have been intoxicated. Shortly after the two brothers headed home, the 32-year-old driver lost control of his vehicle and hit a tree. The force of the collision resulted in the car flipping over and landing on its roof. In the process, the 37-year-old passenger, the driver’s brother, sustained serious internal injuries. He was taken to hospital and hooked […]
