Austin, TX (Law Firm Newswire) March 6, 2013 – A lawsuit has been filed over a golf-front housing development.
The owner of a housing development overlooking a golf course outside of Austin, Texas filed the lawsuit against the owners of the golf course and a neighboring development.
The Golden Bear Reserve is a 21-acre housing development that overlooks the Summit Rock Golf Course in Horseshoe Bay, Texas. Its owner, Reserve at Summit Rock, LP, filed suit against Summit Rock Communities LLC and Horseshoe Bay Resort, the owner of the golf course and the neighboring Summit Rock community.
The lawsuit alleges various acts of wrongful conduct on the part of Douglas Jaffe, Jr., Chairman of Horseshoe Bay Resort, and Douglas Jaffe III, its CEO. Causes of action include monopolization, conspiracy and tortious interference with contract. The petition requests not less than $5,850,000 in damages.

The lawsuit alleges in part that the Reserve was harmed by the defendants’ interference and nonperformance, and by their alleged actions in reformatting the Public Improvement District for their own benefit.
According to allegations in the lawsuit, the defendants took action to divert potential home buyers from plaintiff’s developments to defendants’ developments in an attempt to gain a monopoly in the local home market. The defendants are alleged to have directed security guards to steer home buyers away from plaintiff’s homes and to have taken down signs advertising plaintiff’s properties for sale.
The petition also claims that Jaffe, Jr. and his companies have an unfair advantage over other nearby developers due to their relationship with the International Bank of Commerce (IBOC), the lender for Summit Rock Golf Course.
