Drunken Driver With Extensive Record Runs Over Two-Year-Old

Nov 2, 2012

Austin, TX (Law Firm Newswire) November 1, 2012 – The man in this case had multiple DUIs and was still driving. Enforcement is an issue.

“The drunken driver in this case seems to have had no business driving. He reportedly had a blood alcohol content of .064. He hit a 2-year-old with his car, and left the scene of the accident. The girl made it to hospital alive, but in critical condition,” outlined Austin personal injury attorney Bobby Lee, of Lee, Gober and Reyna in Austin, Texas.

The man also did not have any insurance, which reportedly came as no surprise to the police. He is facing a long string of charges: The 2-year-old was left with tire marks on both her legs, lacerations to her face, internal and external injuries, five fractured ribs, a broken leg and a fractured wrist. Machines are currently helping her to breathe.

The police report states that the driver was heading home when the little girl ran out in front of him. He hit her and kept on heading home, parked his vehicle and went inside. He later told police that he was scared and did not know what to do. “Knowing what to do would seem pretty straightforward to most folks, but being he was that inebriated, I guess he didn’t think it through,” says Lee.

It seems the man was charged in 2008 with driving under the influence, dismissed as a first-time offender and shunted to a deferral program. He violated that program a year later when he was charged with another DUI. The 2-year old is in hospital, fighting for her life.

“If you have been involved in an accident with a drunken driver, call my office. We are happy to advise you of your rights, what compensation you may be eligible for relating to your injuries, how to move forward if you wish to file and lawsuit and represent you, if you so wish,” Lee suggested.

Drinking and driving continues to be a major issue on U.S. roadways, as negligent drivers put others at risk by operating a vehicle under the influence of alcohol.
