Shaun Gayle Files Brain Injury Lawsuit Against NFL

Chicago, IL (Law Firm Newswire) September 3, 2012 – Shaun Gayle, a former defensive back for the Chicago Bears, is suing the National Football League for head injuries he received while playing in the NFL.

The lawsuit is the latest in a series of actions against the NFL regarding brain injuries.”This lawsuit is further evidence that NFL players have suffered traumatic brain injuries,” said Paul Greenberg, a Chicago brain injury attorney.

Gayle had a 12-year career in the NFL, and in the lawsuit, he alleges that the multiple head traumas he suffered have caused symptoms similar to Chronic Traumatic Encephalopathy (CTE). The lawsuit was filed in Cook County Circuit Court.

According to the lawsuit, Gayle suffers from memory loss, headaches and other cognitive deficits. Gayle believes that these problems are the result of several concussions he suffered while he played in the NFL. The lawsuit alleges the league failed to warn him of the dangers to which he would be exposed.

The NFL said that player safety has always been a priority and that the league never misled players. A league spokesperson said that the NFL had taken actions to improve the medical understanding of concussions.

According to Gayle’s lawsuit, the league failed to put policies in place that would prevent him from returning to play after suffering an injury. The suit also claims that the NFL did not require a doctor to clear a player to return to the field after having suffered a concussion.

Gayle is not the only former Chicago Bears player to file suit against the NFL. Dave Duerson’s family filed a wrongful death lawsuit against the league earlier this year, alleging that brain damage from his time on the field contributed to his suicide. Duerson shot himself in the chest, saying that he wanted researchers to be able to study the damage that had been done to his brain.

More than 2,000 former NFL players have filed lawsuits against the league alleging brain injuries.
