Trucker Inattention Kills Construction Worker Says Litigation Funding Corporation

Jan 31, 2012

Southfield, MI (Law Firm Newswire) January 30, 2012 – A construction worker was killed thanks to an inattentive trucker. Hiring a competent lawyer is necessary in cases like this to protect a worker’s rights.

“In this reported case an 18-wheeler struck and killed a construction worker who was installing signs on the side of I-77 in Ohio. The semi, for whatever reason, went off the road and slammed into the man as he was doing his job. The force of the impact threw him into his truck, and then a further 40 feet before he landed,” outlined Darren Monroe of Litigation Funding Corporation in Michigan.

This is a grim accident that did not need to happen. It is not clear what was going on with the trucker just prior to the fatal incident, but if there is a black box on board the rig, it may provide the police with answers to some of their questions. Was the trucker driving while distracted? Drifting off to sleep? Not keeping his eyes on the road? Going too fast for road conditions, as in he did not slow down for construction workers?

The results of the investigation should make things clearer. The trucker did indicate to police that he dropped some papers on the floor, bent over to pick them up, and when he looked up, he saw the man in front of him. If there was anything else happening, only time and an in-depth investigation will reveal what else that may have been.

In the meantime, the worker’s family is faced with the devastating reality of a sudden and wrongful death. Their first, and most logical reaction would be to seek expert legal counsel to find out what their rights are in this kind of situation. While many wrongful death cases are about compensation to allow the family to move forward with their lives, they are also often about the status of the worker.

There are laws that relate to independent contractors, partners and limited liability members and there are also laws that deal with some classes of workers who are exempt from the law. “You need to know what you are dealing with in terms of what you are eligible for, and this is yet one other vital reason to hire a good personal injury lawyer,” Monroe said.

If the worker’s family can take a case like this to court, they will able to apply for pre-settlement funding to bankroll their case. This means the family could use their lawsuit loan to help pay all of their bills and other expenses right away. They would also say no to any offers made by an insurance company that want people to settle out of financial desperation. “All it takes is a phone call or an online application to access the pre-settlement funding application process,” explained Monroe.
