Man Ground to Death in Auger at Pistachio Plant Results in Wrongful Death

Apr 15, 2011

Austin, TX (Law Firm Newswire) April 15, 2011 – Workplace accidents are usually the result of someone’s negligence. This case is no exception.

“It’s disheartening to hear of accident on the job that results in the premature death of someone who had their whole life ahead of them. This case was disturbing in that a 30-year-old man was ground into an auger when he was working on it,” said Robert W. Lee, an Austin personal injury lawyer of The Lee Law Firm in Austin, Texas.

The man was working on the auger, an underground affair for grinding up pistachios, when somehow it started to run. He was shredded alive by the blades. When firefighters arrived, they had to remove his body parts from the equipment and try to determine how the auger started up when he was working on it.

Police on the scene wanted to know if the auger was defective, if someone did not follow safety procedures and turn the machine off while it was being worked on or if someone hit the on switch by mistake, without checking to see if someone was near it. “The incident will most definitely be investigated further to get to the bottom of this needless fatality,” Lee said.

The dead man’s family will have some difficult choices to make as they try and move forward with their lives. They lost the main breadwinner and the financial shock will be significant. How will the family cope economically, mentally and emotionally with this situation?

One solution for this family would be to contact a skilled and highly trained Austin personal injury attorney; one with a track record handling wrongful death cases and one who will aggressively represent the family in obtaining a fair settlement or court verdict.

“An Austin personal injury attorney that knows what the family is facing and how to help them through the process of grieving and obtaining financial compensation for the loss of their family member,” Lee said.
“My office has significant experience in this area and we would be honored to help assist a family needing to discuss a wrongful death case. We understand it is difficult and we offer you the dedication and loyalty you need at a terrible time in your life. It’s my job to help you get what you deserve, should you choose our firm to represent you,” Lee said.
