Baby’s Injury at Birth Results in Medical Malpractice Award of 19.3 Million

Southfield, MI (Law Firm Newswire) February 9, 2017 – Parents of a newborn daughter with severe brain damage filed a medical malpractice lawsuit alleging negligence in the baby’s delivery.

A Pennsylvania hospital and a local doctor had to pay $19.3 million to settle a medical malpractice lawsuit filed by the parents of a brain damaged baby. The settlement agreement set aside $9.05 million in a special account to care for the child and another $2 million was paid to the child’s mother.

The lawsuit, filed in 2014, alleged the physician was negligent in delivering the couple’s baby in 2012, by failing to immediately perform an emergency C-section when the mother showed clear signs of placental abruption — a medical condition in which a placental detachment deprives the baby of oxygen. The baby’s extensive brain damage left the child unable to feed herself, walk or talk.

Moving forward to handle such a catastrophic brain injury is emotionally and financially draining.
