New Drunk Driving Law Goes Into Effect in Texas for First Time Offenders

Oct 15, 2015

Austin, TX (Law Firm Newswire) October 15, 2015 – Texas has a new drunk driving law that may affect first time DUI offenders by giving them the option to install an ignition interlock system in their vehicle. Even though it is an optional choice for those drivers, many feel it is still a step in the right direction to reduce drunk driving.

Ignition interlock systems require the driver to blow into the device before they can start their vehicle. This new law also mandates that the convicted offender absorb the cost of the device and its installation. Those convicted of DUI with a blood alcohol content of less than 0.15 percent may be able to drive if they have an ignition interlock system installed in their car. Previously, those drivers would get a license suspension and would often still drive, even when suspended.

According to a recent federal report, authored by the government, 40 percent of all deaths on the roads in Texas are the result of drunk drivers. In fact, Texas leads the nation in the number of drunk driving deaths, with a staggering total of 1,300.

Many proponents of harsher punishments for drunk drivers feel the new law will save lives by addressing the problem of drinking and driving before it has a chance to escalate. Those suggesting the law is too judgmental do not always take into consideration the high number of repeat offenders on the roads, many of whom have been involved in numerous collisions and may have seriously injured or killed someone.

“Despite the new law, many Texas plaintiff’s DUI attorneys realize that people will continue to drink and drive,” said Austin DUI attorney Bobby Lee of Lee, Gober & Reyna. While they express hope that this new law helps reduce the number of drinking and driving accidents, injuries and deaths, they realize that for the new law to be truly successful, people have to want to voluntarily stop driving while under the influence. “That is not always possible for some individuals and that is why plaintiff’s DUI counsel continues to be the voice of those injured in collisions involving drunk drivers,” Lee said.

  • Drunk driver with history of offenses kills homecoming king
Occasionally a drunk driver involved in a fatal accident has enough sobriety to realize that they killed someone by driving while inebriated. Just such an event happened in Minnesota when a drunken pickup truck driver collided head-on into a vehicle being driven by a 17-year-old homecoming king. The victim was an athlete, well-liked, involved with the school band and had plans to go to college. Scenes like this one occur daily on Texas roadways. The teenager was about a mile from his home at 8:25 p.m. when the fatal accident happened. His sister and a friend were in the car […]
  • Innovative Canadian police texting campaign uses hearse
Sometimes other jurisdictions come up with innovative ways to deal with various issues faced by law enforcement and lawmakers — such as texting while driving. It is certainly not just an American problem. It is rampant in Canada as well. Toronto City Police have come up with a campaign that grabs attention. It involves a hearse, and so far, it has started a buzz on social media that has put the topic of distracted driving front and center. The campaign is dubbed “That Text or Call That Could End it All,” and distracted drivers can expect to be ticketed by […]
  • New app may be a wake up call for addicted texters
Many texters do not realize that driving while distracted is deadly. Just because texting while driving may not cause an accident right away does not mean there is no risk of accident, serious injury or death. The habit is deadly and kills thousands every year. In response to the rising number of deaths due to distracted driving every year, app developers have been working to devise a way to stop drivers from texting while driving. It is addictive to chat with friends, family, lovers, roommates and relatives on the go, but it is not worth it to respond or send […]
  • Drunk driving can land you in jail even if you have had no accidents
Houston habitual drunk drivers can end up in jail if they have an extensive record for driving while intoxicated (DWI). It happened recently in the case of Bobby Martin, a 64-year-old Montgomery County resident, who was handed 10 years behind bars for his 10th drunk driving conviction. Texas jails are home to 32 other inmates doing time for having three or more DWI convictions. Martin’s record shows he has done prison time twice before for DWI convictions — one four-year sentence and one 15-year sentence. Montgomery County has the dubious distinction of having the most DWI drivers behind bars (four) […]
  • Dallas faces reconfiguring a poorly designed street that resulted in a sudden death
The street that Emily Javadi lived on was notorious for accidents. Javadi had parked her vehicle and was on the curb, reaching into the backseat. She was heading for the local gym. Seconds later a speeding vehicle rammed into her car, catapulting Javadi into a metal pole. Although she arrived at the hospital alive, she succumbed to her injuries later. According to the police report, 23-year-old Travis Elwell, allegedly driving under the influence of alcohol, was behind the wheel of his car when he slammed into her parked car. He did not see the parked vehicle or Javadi. He was […]
