Air in Intravenous Line Causes Severe Brain Injury for Newborn

Oct 29, 2014

Southfield, MI (Law Firm Newswire) October 29, 2014 – In May 2012, the parents of a baby girl born February 2010 filed a medical malpractice against Spectrum Health’s Helen DeVos Children’s Hospital in Grand Rapids, Michigan.

“The Gort family alleged that air was introduced into their child’s IV line during a jaundice exchange transfusion,” explained Daren Monroe, a Litigation Funding Corporation representative. The air in the IV line caused loss of oxygen and blood to the brain. The toddler subsequently sustained a severe brain injury. The hospital admitted there was negligence involved in this case and that it was responsible for damages. The case was to go to court in early August to determine the amount of damages owed.

“The same day as the trial, the hospital settled out of court, thus avoiding it,” noted Monroe.

The Gort family had a long journey to get to the point where the hospital extended them a settlement offer. For four years, they struggled to provide the best care they could for their disabled child and the best life for her two siblings.

“A lawsuit loan may have helped them to pay their debts and expenses,” Monroe suggested. “Litigation funding, also called pre-settlement funding, is often a good alternative when a family is cash-strapped and struggling to keep their heads above water.”

Litigation funding is not for everyone, but it is appealing to a number of plaintiffs faced with overwhelming bills and no way to pay them. Once they are approved for a lawsuit loan, the money is sent directly to their bank account and may be spent immediately upon arrival.

There are no up-front or monthly fees involved in applying for a lawsuit loan. Applicants do not need to have a job and do not need to submit to a credit check. The funding allows the family to deal with all their bills while they wait for their case to be handled by the courts, or as in this case, be settled out of court. “With money in the bank, the family would not have to deal with insurance companies who want them to settle quickly and for pennies on the dollar,” added Monroe.
