Personal Injury Attorney Hale Suggests Second Opinion When Suspecting Medical Malpractice

Sep 2, 2013

Waxahachie, TX (Law Firm Newswire) September 1, 2013 – According to the Centers for Disease Control (CDC), at least 40 percent of people who go to the doctor leave the medical office feeling that they have been misdiagnosed.

The Institute of Medicine reports that more individuals die in the U.S. each year due to some form of medical malpractice, including a medical misdiagnosis, than the number of people who die annually from accidents on the nation’s highways, or from breast cancer. Medical malpractice is a real health threat, and medical misdiagnoses happen with alarming frequency.

“Typically, an individual begins to suspect a medical misdiagnosis only after they find their symptoms are worsening after beginning treatment, such as taking prescription medications,” commented John Hale, a Waxahachie personal injury lawyer. “But sometimes, they can leave the doctor’s office feeling that their symptoms were not taken seriously, or their concerns were dismissed.”

Medical misdiagnosis falls under the umbrella of medical malpractice. A typical medical misdiagnosis happens when a health professional, or doctor, either fails to diagnose a condition or disease in a timely fashion, or incorrectly diagnoses a condition. Medical professionals such as doctors and physician’s assistants have a duty to provide their patient’s care in accordance with prevailing medical standards. When they fail to do so, it’s negligence and the basis for a medical malpractice claim. Victims of medical malpractice are entitled to specific compensation under Texas law.

“When you have a medical issue, work as your own health advocate,” says Hale. “Pursue a second opinion from another doctor, if you feel your concerns were not taken seriously, or that your condition was not adequately examined.”

Any individual who feels that they have been misdiagnosed or was otherwise a victim of medical malpractice may wish to keep notes of doctor visits and medications, and bring those concerns to a personal injury attorney to explore their legal options.

  • Blood Thinner Side Effects of Pradaxa Triggers Multiple Lawsuits
Following the formation of the pharmaceutical Pradaxa multidistrict litigation (MDL 2385) in late 2012, there have been more than 640 new federal claims filed. The majority of plaintiffs are alleging that the blood thinner has caused them internal bleeding and other potentially life-threatening side effects. Dabigatran, better known as Pradaxa, marketed by Boehringer Ingelheim, is an anti-coagulant prescribed to millions of patients since its release in 2010. Now patients are coming forward with claims of life-threatening and other serious side effects. An FDA MedWatch report states that Pradaxa caused at least 542 known deaths in 2011, the year after it […]
  • Surgical Complications Can Mean Good Business for Many Hospitals
According to an article published this April in the Journal of the American Medical Association (JAMA), rather than lose money when things go wrong, hospitals typically profit from the medical mistakes they make, whether or not negligence is involved. Interestingly, hospitals are compensated by insurers when patients stay hospitalized longer and additional care is required to address surgical complications and post-surgical errors. The study, “Relationship Between Occurrence of Surgical Complications and Hospital Finance,” looked at the results of nearly 35, 000 surgical discharges, the most common surgical procedures and complications, and how those were handled by insurers. The researchers also examined […]
  • Better Workplace Regulations And Stricter Enforcement of Current Regulations Key to Workplace Safety
The recent fertilizer plant explosion which caused multiple fatalities and serious injury in West, Texas, has raised the public visibility of workplace safety issues. “Every worker should be able to feel that their safety and the safety of their coworkers is a priority,” stated Waxahachie personal injury attorney John Hale. “But unfortunately, workplace safety continues to be a major concern in Texas.” April 28, 2013 was Worker’s Memorial Day, during which a vigil was held for 56 workers fatally injured in 2012 in Houston workplace accidents and other Texas workers who had been killed. The spokesperson for United Support & Memorial […]
  • Calls From Concerned Citizens A Help In Combating Drunk Driving
Calls from passing motorists can help Texas police locate drunk drivers and get them off the road. Many of the calls emergency dispatchers receive must be transferred to other jurisdictions and the 911 callers may not be present to see the driver they suspected of driving while inebriated, but both Texas dispatchers and police have stated that passing motorists are a great help. The director of Mothers Against Drunk Driving, Jeff Miracle, says that he speaks to someone approximately once a month who feels they called 911 to report a potentially drunk driver, only to have to eventually give up […]
  • Texas Highways Safer Than They Were, Still Potentially Dangerous For Drivers
Though traffic fatality numbers have dropped over the past few years, Texas highways remain dangerous. Among the latest of traffic fatalities, the survivors of a man from East Texas who died have just filed a lawsuit alleging wrongful death. The suit alleges that a truck driver acted with negligence when he backed up his truck and an attached flat-bed trailer against oncoming traffic, which caused a fatal traffic accident. The accident happened in November 2012. According to the lawsuit, the driver of a Peterbilt truck which was hauling a flatbed trailer missed a turnoff in Franklin County. The driver continued […]
