BAC Level of .106 Causes Innocent Driver to Slam Truck into a Cement Wall

Jan 16, 2013

Austin, TX (Law Firm Newswire) January 15 , 2013 – The innocent driver in this case died in hospital after this accident. The other driver blew .106 on the breathalyzer.

“The others drivers on the freeway had never seen anything like this accident,” said Austin personal injury attorney Bobby Lee, of Lee, Gober and Reyna in Austin, Texas. An electrician was heading south on the freeway in the early morning hours, when he suddenly swerved to avoid hitting a car. He ended up crossing five lanes of traffic. “This forced a Chevy pick-up to slam into a cement wall. The driver made it to hospital alive, but died as a result of his severe injuries.”

The police accident report indicated that the electrician smelled of booze and his eyes were glassy. The results of a roadside breathalyzer indicated his blood alcohol content was .106, supposedly the result of a couple of beers and some vodka. “Which the police found a bit difficult to believe, and the same reaction was expressed in court as well,” added Lee. He was held on a $450,000 bond for the death of the 21-year-old truck driver, who he ran into a cement wall.

As it turned out, the electrician had a jacket citing a conviction in 2003 for attempted possession of a controlled substance and a firearm conviction in 1995. Evidently, his driving record was clean, until the accident that killed the young man on the freeway.

What are the chances the man will be convicted of drunken driving causing death? “Given the fact that his blood alcohol content was .106, that he smelled of booze and his eyes were glassy, the chances are fairly high he will be convicted, whether he has a clean driving record or not. Due to his negligence, drinking and driving, he killed an innocent young man who was just on his way home, and minding his own business, when out of the blue, he was run into a cement wall by a drunk driver,” recounted Lee.

Drunken drivers have no business being on the road – period. And yet, it still happens, every day, in every city across the nation. People do not pay attention to the laws relating to drinking and driving; always thinking they are above the law and that nothing would ever happen to them.

“Sadly, something usually does happen to them, and to someone else, who never should have been involved in the first place, but for the fact that some idiot wanted to drink too much and prove they could still handle driving. Don’t drink and drive is pretty clear, for compelling reasons, and yet, it still happens, leaving families to pick up their shattered lives,” Lee said.
