Austin Oil and Gas Attorney Jordan Highlights Recent Mineral Rights Dispute Case

Austin, TX (Law Firm Newswire) October 6, 2011 – A recent Texas oil and gas lawsuit pits two parties against each other over land and mineral rights. Red Boot Production Co. says that it owns oil and gas leases on 38 acres of land. Red Boot claims to have the mineral rights under a Beaumont Irrigation Co. canal on the property.

Samson Lone Star (and the other defendants) allegedly has two wells close to the canal. Red Boot says that Samson has used these wells to get gas and gas condensate from under the canal without any right to do so. In its complaint in Jefferson County District Court, Red Boot seeks to recover the money Samson has made from draining the hydrocarbons under the canal, where Samson has allegedly trespassed for four years. Red Boot also is seeking to have Samson’s title to the oil, gas, and minerals in the canal area quieted.

Complaint documents claim that the surface locations for Samson’s wells are on its own land, but that the wellbores bottomhole into Red Boot’s lease. A directional bottomhole survey allegedly shows the bottomholes are within the boundaries of the canal. “One question should be whether Samson’s mineral interests to that area are valid,” said Jordan.
